What are Education Lawyers?
An education lawyer is a person who is qualified as an attorney and specializes in education law. Education lawyers work to ensure that children have equal access despite their different abilities, race, income and color. The lawyers are approached by parent or social activities to take up individual or institution cases. Mainly the lawyers handle funding related cases on behalf of schools and discrimination cases on behalf of individual students.
Education lawyer are professionals who have concentrated on school law, which is a branch of civil law covering the regulations and laws that govern state and federal education. This includes the administrative and operative systems in education institutions. Other areas covered by the education law include school athletics, school programs, school materials and instruction methods used in schools. As such, an education lawyer handles cases filed by the school faculty, students and staff. Some of the popular cases handled by the education lawyers include discipline cases, discrimination based on color, race, nationality, disability or sex.
The guiding laws in the professions include the Equal educational Opportunities Act, which addresses the provision of education opportunities equally among all students and transportation of all students, the Federal education Amendment (1972), which addresses equal treatment of all students, the disabilities in education act (IDEA) and the disabilities act, which is applicable for both adults and children.
The education lawyers also represent schools in lawsuits filed by parents and may advise teachers who would like to present their cases to a teacher’s union in cases involving employment disputes. Just like other lawyers, an education lawyer needs to have a BA or BS degree or an undergraduate degree and LSAT. They also need to have graduated from law school, after which they are licensed to practice law. Depending on which state one wishes to practice education law in, they may be required to pass the bar exam and/or the legal responsibility test.
